Through the mediation process, a trained, neutral third-party — or mediator — takes a non-adversarial approach to assist the parties in resolving their dispute. The mediator helps the parties communicate with each other, listens to them as each side presents their positions, helps them frame those positions to focus on their goals. The mediator then helps the parties generate options to resolve the conflict and can suggest his own. Even if the mediator is a lawyer, the mediator does not represent either or both parties. He is simply someone with experience and expertise who can assist you in reaching an agreement and then preparing the paperwork you need to bring to court.
